Terms of Service

These Terms of Service ("Terms") govern your use of the Delta Squad Racing mobile application and website (collectively, the "Service"), operated by Delta Squad Racing ("we," "our," or "us"). By creating an account or using the Service, you agree to be bound by these Terms.

Eligibility

You must be at least 18 years old to use Delta Squad Racing. By using the Service, you represent that you are at least 18 years old and that your use of the Service complies with all applicable laws and regulations in your jurisdiction.

Account Registration

Access to Delta Squad Racing requires an invitation. To create an account you must:

• Possess a valid invitation code
• Provide an accurate, working email address
• Verify your email address via the confirmation link we send
• Create a secure password

You are responsible for maintaining the confidentiality of your account credentials. You agree to notify us immediately at hello@deltasquadracing.com if you suspect unauthorized access to your account.

You may not share your account with others, transfer your account to another person, or use another person's account without their permission.

The Service — What It Is and Isn't

Delta Squad Racing provides machine learning-based probability scores for Thoroughbred yearlings at auction. These scores estimate the statistical likelihood that a given yearling will win a Grade 1 race based on pedigree and historical data.

Our predictions are:

• Statistical estimates based on historical patterns, not guarantees
• Subject to error, model limitations, and data gaps
• Intended as one input among many in your own research process
• Not a substitute for expert veterinary, bloodstock, or professional advice

We make no warranty, express or implied, that any horse identified by our model will win any race or generate any financial return. Past model performance does not guarantee future accuracy.

Acceptable Use

You agree to use the Service only for lawful purposes and in accordance with these Terms. You agree not to:

• Scrape, copy, or redistribute our data, scores, or ML outputs without written permission
• Attempt to reverse-engineer, decompile, or extract our underlying ML model or data
• Use automated tools (bots, scrapers, crawlers) to access the Service
• Share your access credentials or invite codes with unauthorized parties
• Use the Service in any way that could damage, disable, or impair it
• Attempt to gain unauthorized access to any part of the Service or its infrastructure

Intellectual Property

All content, features, and functionality of the Service — including but not limited to the ML model, scoring algorithms, data presentations, design, and code — are owned by Delta Squad Racing and are protected by applicable intellectual property laws.

You are granted a limited, non-exclusive, non-transferable license to access and use the Service for your personal, non-commercial use. This license does not include any right to sublicense, sell, or commercially exploit any part of the Service.

Data and Privacy

Your use of the Service is also governed by our Privacy Policy, which is incorporated into these Terms by reference. Please review our Privacy Policy to understand our data practices.

Account Termination

By You: You may delete your account at any time from within the app (Settings → Delete Account) or by contacting us at hello@deltasquadracing.com. Account deletion is permanent and irreversible.

By Us: We reserve the right to suspend or terminate your account at our discretion, with or without notice, if we determine that you have violated these Terms or that your use of the Service poses a risk to other users or the integrity of the Service.

Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

We do not warrant that the Service will be uninterrupted, error-free, or free of viruses or other harmful components. We do not warrant the accuracy, completeness, or reliability of any data, scores, or predictions provided through the Service.

Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, DELTA SQUAD RACING SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, OR GOODWILL, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE SERVICE.

IN NO EVENT SHALL OUR TOTAL LIABILITY TO YOU FOR ALL CLAIMS ARISING FROM OR RELATED TO THE SERVICE EXCEED THE GREATER OF (A) ONE HUNDRED DOLLARS ($100) OR (B) THE AMOUNT YOU PAID US IN THE TWELVE MONTHS PRECEDING THE CLAIM.

Indemnification

You agree to indemnify and hold harmless Delta Squad Racing and its owners, operators, and affiliates from any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or in connection with your use of the Service or violation of these Terms.

Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Washington, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts located in Washington State.

Changes to These Terms

We reserve the right to modify these Terms at any time. We will notify you of material changes by updating the "Last updated" date and, where appropriate, by sending notice to your registered email address. Your continued use of the Service after any changes constitutes your acceptance of the new Terms.

Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Delta Squad Racing regarding your use of the Service and supersede all prior agreements and understandings.
